Fallowing Information

 The Fallowing Application window for the 2024 year has closed.

 The Mendocino Cannabis Department will be accepting Fallowing applications from December 1st, 2023, through December 31st, 2023, for applicants who wish to fallow all or portion of their Canopy in 2024.  

Fallowing submissions must include a completed Notice of Fallowing and a Fallowing Site Plan. The Fallowing Site Plan must clearly show the fallowed area and include the total square footage of both the fallowed canopy and canopy that will remain in use.  The Fallowing Site Plan must match the Site Plan MCD has on file with your application.

Fallowing Applications must be submitted via email to mcdpod@mendocinocounty.gov. Only complete fallowing submissions will be accepted. Both the Notice of Fallowing and Fallowing Site Plan must be included in a single email submission. 

Fallowing is a tax status that can potentially lower your True-Up tax for the fallowed year. Applicants who fallow all or a portion of their canopy are still subject to annual renewal and inspection by MCD staff.  Fallowing does not affect your status with DCC, and you must continue to renew your state license.

  • 2024 Fallowing applications submitted before December 1st or after December 31st will not be accepted.
  • Incomplete Fallowing applications will not be accepted.

Applicants who file a Notice of fallowing for 2024 will be required to complete their fallowing application by submitting an Affidavit of Fallowing and Fallowing Site Plan in January of 2025.

2023 Fallowing Information

Applicants who filed to fallow for 2023 will be required to complete their fallowing applications by submitting an Affidavit of Fallowing along with a fallowing site plan. The 2023 Affidavit of Fallowing will be accepted January 1st, 2024, through January 31st, 2024.  The Site Plan submitted with the Affidavit of Fallowing must clearly show the fallowed area and include the total square footage of both the fallowed canopy and canopy that will remain in use. Additionally, the site plan must be consistent with the Site Plan submitted with your Notice of Fallowing.

The Affidavit of Fallowing must be submitted via email to mcdpod@mendocinocounty.gov. Only complete Affidavit of Fallowing submissions that include a site plan will be accepted. Both the Notice of Fallowing and Fallowing Site Plan must be included in a single email submission. 

  • 2023 Affidavit of Fallowing submitted before January 1st or after January 31st will not be accepted.
  • Incomplete Affidavit of Fallowing applications will not be accepted.

Completed 2023 Fallowing applications will be processed in February 2024. Once processing is complete, MCD staff will notify applicants as well as the Treasurer Tax Collector as to the tax status of all CCBLs with completed Fallowing applications.
